Train90 Partner terms
These terms apply when a personal trainer, studio or gym joins Train90 Partner. Please read them before you join. By ticking the box on the signup form and pressing Join, you agree to them.
Version 1.8 · Effective 29 October 2026
1. Who we are and who you are
Us: David Silver trading as Train90 (ABN 54 970 821 702), Queensland ("Train90", "we", "us", "our"). Contact: david@train90.com.au.
You: the business named on your signup form, and the person who signs up for it ("you", "the partner"). If you sign up for a company or partnership, you confirm you're allowed to accept these terms for it.
2. What Train90 Partner is
Train90 Partner gives you a website with your business name, logo, colours, contact details and prices (your "partner site"). Your clients use it to answer a pre-exercise screening and questionnaire and get a 13-week training program built by the Train90 program engine from a reviewed exercise library, with a calendar feed, check-ins (on the Adaptive plan) and a retest.
You also get an admin page to see your clients and their programs, switch plan approval on or off, review any program flagged by the automatic safety checks, and connect your own Stripe account so clients pay you directly.
Your client terms and privacy policy: your partner site shows client terms of use and a privacy policy based on Train90's templates, with your business name and contact details. They're your terms and your policy: you adopt them as your own, you're the supplier of the training service to your clients, and your clients' agreement is with you. The client privacy policy names Train90 as your platform provider.
Your partner site starts at your-name.train90.com.au. You can connect your own domain by following our instructions.
Your name and brand: pages and calendar invites carry your name and branding. Emails to your clients show your business name and are sent from Train90's shared email address, and replies come straight to you. A small "Powered by Train90" credit appears in the footer of your site.
3. Plans and prices
All prices are in Australian dollars and are the full amounts you pay.
- Starter: $99 a month. Up to 25 active clients a month. 1 trainer. One-off establishment fee $199.
- Pro: $149 a month. Up to 100 active clients a month. 1 trainer. One-off establishment fee $299.
- Studio: $299 a month. Up to 300 active clients a month. Multiple trainers. One-off establishment fee $499.
- Gym: $399 a month. Up to 400 active members a month. Unlimited staff. One-off establishment fee $699. Each active member over 400 in a month costs $1.
Founding partners: the establishment fee is waived for our first 5 partners. Your founding place is held for you when you press Join and stays held while you finish paying (up to 2 hours). Founding-partner pilot places offered by invitation don't use founding places.
Graduate offer: if you join within 12 months of completing your Certificate IV in Fitness and choose the graduate offer, you join the Starter plan with no establishment fee. Your first 6 months are free, then you pay $19 a month for the next 6 months, then the standard Starter price ($99 a month) until you cancel. Your card is saved when you join and nothing is charged during the free months. Stripe emails you before your first charge. We check your qualification certificate (it must show a Certificate IV in Fitness completed within the last 12 months) before your site goes live. While the graduate pricing runs (your first 12 months), plan changes are made by emailing us. The offer applies once per person.
Course provider trainers and assessors: trainers and assessors at a registered training organisation (RTO) that has a partnership with us can join the Pro plan at no charge for as long as that partnership runs, using their RTO's link. Clauses 4 and 8 still apply. If the partnership ends, we'll give you at least 30 days' notice by email before any fee applies, and nothing is charged unless you agree.
Extra active clients: each active client over your plan's limit in a month costs $2 ($1 on the Gym plan), billed monthly in arrears (on the following month's invoice).
Active client: a client counts as active in a month if their full 13-week program is unlocked at any time during that month. Free first-week previews don't count.
Gym plan: your members are your clients under these terms. They unlock their plan with your member code and don't pay Train90 or you through the partner site. You set your own member cost policy: for example, part of every membership, part of a premium membership tier, or a paid add-on that you charge for yourself. Tell your members clearly what it costs them under your membership terms, and don't describe it as included in a membership unless it is. You decide who receives the code. You must name a qualified trainer who meets clause 8 and is responsible for members' programs, and you must remove anyone who stops being a member from your admin page.
Staff access: on your admin page, each person you add is an owner, head trainer or trainer. Trainers see only the clients or members assigned to them. Head trainers and owners see every client or member; only owners see business figures, billing and the staff list.
You can move to another plan at any time from your admin page or by emailing us. The new price applies from your next billing date.
We may change our prices by giving you at least 30 days' notice by email. If you don't want to continue at the new price, you can cancel before it starts.
4. Joining and going live
You pay your first month (and the establishment fee, unless it's waived) by card through Stripe when you join. Stripe then charges your plan each month on the same date until you cancel.
We check your qualification, insurance and business details after you join. If we accept your application, your partner site will be live within 2 business days of receiving your qualification and insurance documents (usually the same day). We email you your web address and how to sign in.
If we don't accept your application, we refund everything you've paid in full and cancel your plan. We don't have to give a reason, but we usually will.
5. Refunds
30-day money-back guarantee. If you cancel within 30 days of the day you join and email us to ask, we refund everything you paid when you joined: your first month's plan fee and the establishment fee (if you paid one). We refund to the card you paid with, usually within 5 business days. The guarantee applies once per trainer or business.
Outside the guarantee, the establishment fee covers setting up your site, and once your site is live it isn't refundable, except as required by law.
Monthly fees aren't refunded for part months, except as required by law or under the guarantee above.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded. Where the law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.
6. Cancelling
Your plan runs month to month. There's no lock-in contract.
You can cancel at any time from your admin page (Manage billing) or by emailing us. Cancelling stops future payments. Your site stays live until the end of the period you've already paid for, then it goes offline.
When your site goes offline, each of your clients can still open their current program, read only, for 30 days, and we tell them by email. After that, their program links stop working.
Exporting your clients: during that 30-day read-only period (and at any time while your plan is active), you can download a CSV file of your clients from your admin page ("Export my clients (CSV)"). It has the same columns as your daily client spreadsheet (clause 10), so you can keep looking after your clients. Clause 10's rules for the spreadsheet apply to the export too. After the 30 days we keep and delete records as clause 10 describes.
7. Failed payments
If a monthly payment fails, Stripe retries it and emails you to update your card. If a payment is still unpaid 14 days after it was due, we pause your partner site until it's paid. Your clients can't build new programs while it's paused.
If the payment is still unpaid after that, we may cancel your plan. Clause 6 then applies as if you had cancelled, including your clients' 30 days of read-only access.
8. Your responsibilities
You agree that you:
- Hold at least a Certificate IV in Fitness (or an equivalent or higher qualification) and any registration your work needs.
- Hold current professional indemnity and public liability insurance that covers online programming, keep it current while your site is live, and send us your new certificate of currency before your current one expires. We may pause your site if your insurance lapses.
- Give us true and complete information when you join, and tell us promptly if it changes.
- Are responsible, as their trainer, for the clients who join through your site, including how you look after them, answer their questions, follow up any pain or safety reports, and any program you review, edit or approve.
- Follow the screening outcomes on your site. If a client is asked to get GP clearance, you don't override that.
- Set your own client prices and terms, take payment through your own Stripe account, and handle your clients' refunds, complaints and any tax obligations on your income.
- Comply with the law, including the Australian Consumer Law and the Privacy Act 1988 (Cth). Because you provide a health and fitness service and hold health information about your clients, you must handle your clients' personal and health information in line with the Privacy Act and the Australian Privacy Principles, whatever your turnover, and use it only to train, support and look after those clients.
- Don't use Train90 Partner to make medical claims, or to offer services you aren't qualified or insured to provide.
- Keep your admin sign-in to yourself and the trainers you add, give each person only the role they need, remove people who leave your business straight away, and tell us straight away if you think someone else has used a sign-in.
9. Our responsibilities
We will:
- Provide, host and maintain your partner site, the program engine, the reviewed exercise library, the automatic safety checks and your admin page, using reasonable care and skill.
- Keep the exercise library and programming rules reviewed and signed off by a qualified fitness professional. This doesn't include custom exercises you write (section 10C).
- Fix faults within a reasonable time once we know about them. We aim to keep your site available at all times, but it may sometimes be unavailable for maintenance or for reasons outside our control.
- Tell you by email about any change that significantly affects how your site works.
- Answer your support emails, usually within one business day.
10. Client information and privacy
- Your clients, your responsibility: you're responsible for your relationships with your clients and for your clients' personal information, including health information. Clients sign up on your site, agree to your client terms and privacy policy (clause 2), and pay you directly.
- We handle it on your behalf: we collect, store and use your clients' information on your behalf, only to provide, host, support, secure and maintain the platform and to deliver their programs, as described in the privacy policy on your site. We don't use it for our own purposes. We may use de-identified or aggregated information that doesn't identify any client (for example, how many programs were built or how often sessions are completed) to maintain and improve the platform, and for nothing else.
- Stored in Australia: client information on partner sites is stored in Australia (Sydney). The service providers we use to run the platform (such as hosting, email and payment providers, and our AI provider, which receives only de-identified program details) are listed in the client privacy policy. Health screening answers are only used for safety screening and are never sent to our AI provider.
- What you can see: your admin page shows your clients' details, programs, check-ins and safety reports, limited by each person's role (clause 3).
- Daily client spreadsheet: each morning we email your business owner a spreadsheet of your clients. It contains health and safety information: each client's screening outcome (not their detailed screening answers), injury and limitation areas, Active Ageing cautions, and whether they've reported pain or a fall or dizziness at a check-in, as well as their contact and program details. You must store it securely, use it only for client care and safety, not forward it outside your business, and delete old copies when you no longer need them.
- No marketing to your clients: we never market Train90 or anything else to your clients, and we never sell their information.
- Access and correction requests: if a client asks you to see, correct or delete their information, email us and we'll help you respond promptly (the Privacy Act generally requires a response within 30 days). If a client contacts us directly, we'll tell you and work with you on the response.
- When your plan ends: we keep and then delete or de-identify your clients' records as the client privacy policy describes, and we don't use them for anything else in the meantime.
- Your information: we handle the information you give us when you join (including your name, contact details, ABN, qualification, insurance details, Working with Children card details and documents) under Train90's privacy policy at train90.com.au/privacy, to assess your application, run your account and contact you.
- Data breaches: if we become aware of a data breach affecting your clients, we tell you promptly and work with you on any notification the Notifiable Data Breaches scheme requires. If you become aware of one (for example, a lost device holding the daily spreadsheet), tell us promptly too.
10A. Train90 Family (12 to 15-year-olds)
Train90 Family lets a parent on the Adaptive plan add a child aged 12 to 15 to their plan, with the parent supervising every session. It's switched off on your site by default.
You may switch Family on in your admin settings only if every trainer who will deal with Family clients (including supervising, reviewing or answering questions about their programs) holds a current Queensland Working with Children (blue) card, or the equivalent working with children check in the state or territory where they work, and your insurance covers online programs for 12 to 15-year-olds.
While Family is on, you must record each of those trainers' card or check number and expiry date in your admin page and keep them up to date. If any card or check lapses, is suspended or cancelled, or your insurance stops covering under-16s, you must switch Family off straight away (or stop that trainer dealing with Family clients) until it's fixed. We may switch Family off on your site if the details aren't recorded or have expired.
10B. Nutrition
Nutrition gives your clients a week of meals built around their training and a weekly shopping list. It's general guidance based on the Australian Dietary Guidelines, with health screening first that refers some clients to a GP or Accredited Practising Dietitian instead of giving a plan. It's on for your site by default, and you can switch it off in your admin settings at any time.
By default it gives every client everyday portions from the Australian Guide to Healthy Eating, without personal calorie or macronutrient targets. This keeps it within the general nutrition advice that registered exercise professionals may give.
Calorie and macronutrient targets for clients aged 18 to 64 are switched on only if you ask for them in your admin settings and we approve your request. You must record a nutrition qualification that covers individual calorie and macronutrient advice and confirm that your professional indemnity insurance covers it, and send us a copy of the certificate and your insurance schedule when we ask. We may decline or withdraw approval at any time. You must tell us straight away if the qualification or cover stops applying.
While nutrition is on, you're responsible for the nutrition service to your clients in the same way as for their exercise programs. Nutrition answers are health information: you must handle them under section 10. We may switch nutrition off on your site at any time, for example if we change or withdraw the feature.
10C. Program writer: your own exercises and written plans
If we switch the program writer on for your site, your admin page also lets you (writing: owners and head trainers; approving custom exercises: owners only):
- Write your own exercises ("custom exercises"), with their set-up, cue, what to watch for, the limitations they're flagged for and their instruction card, and approve them for your clients.
- Write in a client's plan: add, remove and reorder exercises, rewrite coaching cues, week focus lines and the introduction.
- Save plans as templates and start other clients' plans from them.
Custom exercises aren't part of the Train90 reviewed exercise library, and we don't review them. When you approve one, you do so as the qualified exercise professional responsible for your clients' programs, under your own qualification and insurance (section 8), and you're responsible for it and for every plan you write. You must flag every limitation an exercise loads, as the automatic safety checks and "Something hurts?" rely on those flags, and only use exercises within your scope of practice and your insurance. Changing an approved exercise or its card puts it back to draft for another check, and each change and approval is recorded.
Everything you write is still checked against the same automatic safety rules as every program (for example equipment and limitations, set limits and age rules), and plans you mark as written by you aren't rebuilt or changed by AI afterwards. Custom exercises can't be used in Train90 Family programs, and only bodyweight custom exercises can be used for 16 and 17-year-olds. Templates must not contain a client's name or health details.
Your custom exercises, their cards and your templates are yours (section 11), and stay on your site only. We may switch the program writer off on your site at any time, for example if we change or withdraw the feature; plans already written keep what they were given.
11. Intellectual property
We own the Train90 platform, program engine, exercise library, programming rules, software, videos and content we provide, and everything we develop to improve them. Custom exercises, cards and templates you write are yours, and you give us a licence to host and show them on your site. While your plan is active, we give you a non-exclusive, non-transferable licence to use them through your partner site for your clients. You may not copy, resell or reverse engineer them.
You own your business name, logo, photos and the text you give us. You give us a licence to use them to build and run your partner site, and to name you as a Train90 Partner (for example on our website) unless you ask us not to.
12. Liability
Training programs are general fitness information, not medical advice. You're responsible for your services to your clients, and you agree to cover our reasonable losses from a claim by one of your clients that arises from your services, your advice, or your breach of these terms, except to the extent we caused it.
To the extent the law allows, we aren't liable for any indirect or consequential loss, or for loss of profit, revenue or data, and our total liability to you under or in connection with these terms is limited to the fees you paid us in the 12 months before the claim arose.
Nothing in this clause limits liability that can't be limited by law, including under clause 5.
13. Suspension and ending these terms
We may pause or end your partner site, with notice where practical, if you seriously or repeatedly break these terms, your qualification or insurance is no longer current, or we reasonably believe your site is putting clients at risk. If we end it for any other reason, we give you at least 30 days' notice and refund any fees paid for the period after it ends.
Clauses 5, 6 (exporting your clients), 10, 11, 12 and 14 continue after these terms end.
14. General
We may update these terms by giving you at least 30 days' notice by email. If you don't agree to the change, you can cancel before it starts.
These terms are governed by the law of Queensland, Australia, and you and we submit to the courts of Queensland.
If any part of these terms can't be enforced, the rest still applies. These terms, together with your signup details, are the whole agreement between you and us about Train90 Partner.
